Don’t Use Illegal Floors: HC Tells Islamic School

The High Court on Monday said the floors of the Islamic Arabic school at Tondawada village near Tirupati, which are not covered by the building permission, shall not be used.

Justice Nooty Ramamohana Rao, while dealing with a batch of writ petitions against the controversial structure, directed the promoters of the school to explore the possibility of shifting the girls from the building as there is no occupancy certificate, and report back to the court.

It may be recalled that there has been a controversy over this structure constructed by Madarasa-e-Niswan-Isha-Atul-Islam Urdu and Arabic Development Society, through its president Shaik Nowhera. This society filed a writ petition contending that the Tondawada gram panchayat is threatening to demolish the building though they had given an explanation and are ready to pay regularisation fee for the extra floors built by them.

The Tirumala-Tirupati Samrakshana Samiti (TTSS) impleaded into the case. T Subrahmanyam, a farmer who fought a legal battle against the institution and  got the revision dismissed by the government, has also impleaded in this case. One S Munigangi Reddy filed a separate case seeking demolition of the illegal building.

Earlier, the judge had directed the SV University and TUDA to get a report regarding the strength of the building. The collector and the SP were asked to file the reports. The gram panchayat was asked to explain the facts.

On Monday, the district collector submitted a report to the court explaining the facts. The judge wondered how the building was put to use for accommodation for girls when there is no occupancy certificate.

The judge said no further works, including internal ancillary activity, shall be done and the illegal floors shall not be used. The judge enquired why the SP has not submitted the report.

The gram panchayat told the court that the site is within 100 meters of the highway and TUDA is the final authority. The builder was asked to explore the possibility of shifting the inmates. The case is now listed to February 4.
