Madani’s bail petition deferred again

The Fast Track Court (5), Bangalore on Tuesday deferred the anticipatory bail application of Islamist leader Abdul Nasser Madani, 31st accused in the Bangalore bombings case, to June 29 for detailed examination after the Karnataka Police filed its counter-affidavit vehemently arguing against granting bail. This was the second deferment of Madani’s bail application in four days.

The non-bailable warrant issued by the Metropolitan Magistrate Court of Bangalore for Madani’s production was to expire on Wednesday but the Prosecution said it would apply for an extension of the warrant. The Prosecution argued that Madani could not be granted bail as the charges the Karnataka Police had imposed on him were of non-bailable nature. The Metropolitan Magistrate Court was to take up on Wednesday the chargesheet in which Madani was named as an accused.

When Judge Srikant Vadavatti of the Fast Track Court took up the bail application on Tuesday morning, Public Prosecutor Rudra Swamy strongly opposed it, saying Madani did not deserve bail legally. The charges made against Madani were anti-national activity, homicide, criminal conspiracy and unlawful assembly. He added that Madani’s application was not legally sustainable.

But Madani’s counsel Usman argued that his client, like any other citizen, deserved bail. He said his client could be granted bail considering his ill-health, deformity and status as a political leader. Usman also prayed for an interim bail order if the court felt that Madani’s arrest could not be avoided.

Following this, the court postponed the application to be taken up in the afternoon, instructing the Prosecution to produce documents of reasons for opposing the bail application. The Prosecution’s determination to oppose the application became evident as the investigation officer himself appeared in the court to submit the counter-affidavit. The Public Prosecutor said the warrant remained despite the deferment of the plea.

Nazeer had told the Karnataka Police that he had discussed the matter of blasts before and after they were carried out. According to the police, Madani had also visited a terror training camp that Nazeer had organized at Virajpetta in Coorg district of Karnataka. The Prosecution had also made Sufiya, Madani’s wife, a witness against him on the basis of Nazeer’s statements.


Sufiya plea rejected

Kochi | PNS The Special CBI Court (NIA court), Kochi on Tuesday dismissed an application filed by Sufiya, wife of Abdul Nasser Madani, for relaxation of the conditions of bail granted to her in the terror case of burning of a Tamil Nadu State bus at Kalamassery, off Kochi, on September 9, 2005. Sufiya is tenth accused in this case, which is one of the six terror cases the NIA is probing in Kerala. Sufiya had requested relaxation in the condition that she should not leave Ernakaulam district but the NIA argued that she could try to destroy evidences and influence the witnesses if the request was granted. The probe agency’s counsel argued that there were no sufficient grounds for her plea.
