Religous Reservations are unconstitutional-Justice Rama Joyce

Kochi: Even after 50 years of Independence, It’s unfortunate that Nation is still clinging on to Minority appeasement instead of giving equal rights and opportunities to all, Said Punjab Chief Justice Rama Joyce while addressing the National seminar conducted by ABVP on ‘Minority Rights in Educational Field’.

It is unconstitutional to provide special consideration based on Religion and the present appeasement policies will only help to deter the unity and integration of the Nation. Laws in the country should be made or amended considering the National benefits and not based on Religious benefits. Laws of the country should be aimed at giving equal status to all citizen. Those who cite Article 30 to highlight constitutional guarantee for Minority Reservations should also be aware that it is not a Right of any religion, but only a clause aimed to protect the Minorities, Told Rama Joyce

In his inaugural speech, Former Law Minister Dr. Subrahmanya Swami urged the ABVP to come forward and protest against this move to give special reservation to Christians and Muslims at any cost.

It’s an irony that there is no clear cut definition on ‘Minority’ even in our constitution. It was the Muslims and Christians who ruled the Nation in past centuries and Hindus faced severe discrimination at that time. Christians and Muslims never has to face any Religious oppression here, told Swami.

Muslims and Christians cannot be considered as Minorities. In states like Kerala it is the Christians and Muslims controlling the Government itself. Demanding Minority status is absolute farce. If the Muslims are backward in certain states special reservation in all the states is not the answer for that. Parsi’s another Minority in India never cried for any special rights reminded swami.

Secularism disappears when Hindus become a Minority, Jammu and Kashmir is a perfect example for that, swami added
