Oppose the 1000 crore Minority Pampering
Reg.: Rs. 1000 Crore allocation in the Budget for Minorities albeit Muslims- Unconstitutional—must be opposed.
This must be opposed tooth and nail as it violates the constitutional as also RBI Act and it amounts to payment of JIZYA by the majority community for the benefit of MUSLIMS.
Besides, the following comments relevant to opposing the budgetary allocations by the Government on the basis of RELIGION are made hereunder. These deserve strong support from all concerned.
1.Such an allocation is Un-Constitutional since NO allocation can be made on the basis of religion. On Economic considerations, YES but NOT on religious considerations ( as is contemplated in the Union Budget under “expenditure”.
2.In 1951, Chief Justice Kania of the Supreme court heading the Full Bench of Seven S.C.Judges ( who have subsequently became all Chief Justices ) declared Notification , Govt. of Madras appointing Munsif in Judicial Service as COMMUNAL ORDER and declared it void. ( Vide Venkatraman Vs Govt. of Madras 1951 All India Reporter—Supreme Court). The Apex Court has recently turned down “RESERVATIONS” on the basis of religion. Legally, therefore Religion cannot be the basis to receive benefits.Â
Â
3.Such an allocation violates RBI Act of 1934 —Allocation of Currency on Religious Lines NOT ALLOWED, as per the said Act of RBI
4.Opens up wounds of Partition—as per the then prevailing situation of Muslim demands / concessions conceded and finally partition of India
5.Cost of any Concession—Physical, Financial or Otherwise is finally to be borne by the Majority HINDU Community and therefore G.O.I. has No Right to take any such decision without eliciting views of the HINDUS, the Majority community
.
6.Since such an allocation is legally not tenable, it would ultimately be against the interest of Muslims to pursue this further. It would only increase the Muslim / Non-Muslim divide.
7.Such an allocation, on the basis of religion, is tantamount to imposing “JAZYA” the tax imposed by the Muslim rulers on Hindus. This is therefore, NOT ACCEPTABLEÂ and must be opposed tooth and nail
