Guwahati, July 29: The Guwahati High Court has ordered deportation of 50 illegal Bangladeshi settlers and rapped the government for failing to stop infiltrators from getting their names entered in the voters’ list.

Disposing of two writ petitions last week, Justice B K Sharma said there were several common features in all the cases that were used by infiltrators to hoodwink the administration, the police and even the court.

Justice Sharma pulled up both the State and Central Governments for not responding speedily.“Neither the Centre nor the state governments can disown their foremost responsibility of defending the borders of the country, prevent any trespass and make the lives of citizens safe and secure.”

He directed them to exercise “a strong political will unmindful of political gains derived from the presence of illegal migrants and ensure that national interest prevails under all circumstances.”

Justice Sharma said it is very easy to pick up any voters’ list, find out names and particulars resembling theirs, obtain certified copies of the same and dump them in the writ court, taking it for granted that the court will swallow the same, unmindful of requirement of Section 9 of the Foreigners’ Act, 1946.

The petitioners (infiltrators) did not provide any evidence to prove the authenticity of their documents, the Court noted.

“The infiltrators incorporate their names in voters’ list on the basis of which they must have cast their votes. Thus, the petitioners and many others like them present in Assam have a major role in electing the representatives both to the Legislative assembly and Parliament and consequently, in the nation’s decision-making process,” the court noted.
