As per the report Court granted bail to Sairul Sheikh as marriage under 18 is legal under Muslim Personal law. Anita’s mother Jyotsna had lodged a complaint that her daughter had been “kidnapped and married” her minor daughter.
Few Questions
As per Hindu Marriage act of 1955, The age for marriage is 18 for girls and 21 for Boys.
So does it mean by converting to Islam long abolished Child Marriages can be bought back to society? Even one is eligible to franchise their voting right only after 18 years then how come this girl can take the decision to convert to Islam on her own?
Isn’t she still a Minor and isn’t it the responsibility of Judiciary to protect the girl from this Jihadi trap and send the girl back to her family ?
Just like the rights of an individual to select their own partner isn’t there any rights left for Parents who had looked after her all these years?
Isn’t it just fair to wait until 18 years of age and give the girl time to think over whether she should betray her faith and parents to live with a Jihadi?
Isn’t it high time now to implement Uniform Civil Code rather than allowing Jihadi’s to marry and breed from their childhood itself? Â
