HC denies bail to Marad

KOCHI: The Kerala High Court on Thursday refused to grant bail to 23 out of 139 accused in Marad carnage case in which nine persons were killed.

Director-General of Prosecution P G Thampi vehemently opposed the bail applications saying that it was too premature that the bail applications are considered on the basis of some speck of evidence here and there.

The trial judge has to consider the overall evidence in the case and evaluate the context, quality and texture of evidence.

It will be preposterous and pre-emptive to consider the evidence and enlarge the accused on bail, he said.

Accepting this argument, Justice V Ramkumar said it would be more appropriate if the trial judge was directed to consider the request for bail in case a motion was made by the petitioners before that court
