Death for child-abuser-killer

The District Sessions Court, Thrissur, on Wednesday sentenced Hamsu (32) of Kerantakath, Edakkazhiyoor to death for killing a 12-year-old after abusing him sexually. Judge Kamal Pasha, who had the other day found Hamsu guilty of the crime, awarded death sentence to Shamsu, observing the case was one of the rarest of the rare.

The charge against Hamsu was that he murdered 12-year-old Nizamuddin, son of Muhammad, Pulickal, Edakkazhiyoor, Chavakkad after sexually persecuting him on the night of October 28, 2008 on the beach in Chavakkad. The judge said Hamsu deserved no less punishment for the heinous crime than death by hanging.

There were no eye-witnesses in the case, but Judge Pasha had found Hamsu guilty of both crimes on the basis of circumstantial evidences. The punishment was awarded under Sections 302 and 307 of the Indian Penal Code.

Hamsu had taken the boy away from a festival ground, where he had gone at about 5.00 pm on that day luring him with the promise of toys. Several people had seen the boy at the festival grounds till October 28 midnight. However, the boy was found missing the next morning and it was during the search the body was found on the beach.

Hamsu had been found guilty by a juvenile court earlier for the rape of a 10-year-old girl more than 15 years ago. The judge also took into consideration while coming to a conclusion on the Nizamuddin murder case.

As he was asked whether he had anything to tell the court, Hamsu said he was falsely framed in the case. However, the court responded saying that this did not mean anything as the crime had been proved beyond doubt.
