Helplessness of the State – Madani’s arrest

It is pathetic to watch the helplessness of Indian state in the arrest of an accused terrorist like Madani in the Bangalore blast case. Bangalore and Kerala police are completely lost in their determination, control and command of their actions in arresting an accused against whom an unbailable warrant has been issued months ago. The concept of an independent police force has been long lost in India , and the political leadership has completely different calculations in handling such cases. Everyone wants the law to take its own course, but no one wants the police to do the minimum in enforcing law. One cannot help the comparison of the current situation with a similar scenario a few years ago when the revered Swami of Kanchi was to be arrested in a murder case. He was just bundled into a police van the night before Deepavali  and taken to Chennai.
 
Madani’s press conference and public statements clearly reveals the man. He suffers from an acute variant of a mental disease called monopoly of intelligence. He thinks that all others except him are fools. He says he is innocent but he is unwilling to stand trial. He says the entire government machinery is plotting against him. IB and RAW which are supposed to be involved in international espionage are nowadays spending billions of rupees (out of their budget allocation) on plotting against someone like Madani. He thinks no one knows the technicalities of his acquittal in Coimbatore case and that he is completely innocent. He thinks no body knows about the amount of Gulf money that is flowing into his nefarious operations. He thinks no one knows about the Hindus working at his Anwarserry college and the dupe swami he is demonstrating at all public functions. In short he sincerely believes that he is the most intelligent human alive in the 21st century.
 
Madani’s case casts a big shadow on the impartiality and efficacy of Indian law in the dispensation of justice in India . The same situation is going to repeat if and when the state machinery decides to act in the hanging of Afsal Guru and Ajmal Kasab. Threat of demonstration, violent reactions etc., will deter their decision to implement judgments of the Supreme Courts of this land. This is nothing but mockery of our constitution and the laws of the land. Instead of defaming our constitution again and again, the best way out may be to enact separate Criminal law (like Civil law) for the various communities. For example, if the accused in a criminal act is a Muslim (and that too someone like Madani), there must be no arrest and the law must allow questioning in five-star hotels !!! And no punishment even if they are involved in bomb blasts; perhaps a reward may also be considered.
