Marad accused violated bail conditions
KOZHIKODE: Nine accused in the Marad massacre case have violated the bail conditions stipulated by the Kerala High Court, said P D Ravi, Special Prosecutor, in a petition before the Marad Special Court here on Tuesday. The prosecutor cited a report of the Crime Branch Criminal Investigation Department. The report, prepared by the State special branch, had been routed through the Commissioner of Police, Kozhikode city.The petition has named Rizal Babu, accused no.15; Akbar, 18; Razak, 29; Shamshu, 41; Shaukath Ali, 44; Azgar, 58; Siraj, 61; Abdul Jabbar, 66; and Navas, 82; of having violated the bail conditions. The Marad case relates to the killing of seven fishermen at the coastal village on May 2, 2003.Special Judge Babu Mathew P. Joseph posted the petition for consideration to October 14. The prosecution has been directed to produce all documents on that day.
Nearly 89 under trial prisoners are out on bail after agreeing to the stringent conditions. On Monday, 33 accused submitted their passports in court. The High Court asked the accused last week to do so within a week after the Crime Branch moved a petition stating that the intelligence wing suspected that they might flee the country. Except one, all 137 accused had secured conditional bail from the Kerala High Court. They have been directed to reside within a 3-km radius of the trial court. The accused should execute a bond for Rs.2 lakh and reveal the source of the amount. The bond should include three sureties, of which one should be a blood relative. The sureties needed to give a declaration that they would be responsible to bring the accused to the court. At least one of the sureties should always be present with the accused. Those released on bail should not visit any other place other than that of residence and the trial court.
